[ ♪ theme music ♪ ] >> jennifer: i'm jennifer granholm. tonight in "the war room," more than three weeks have passed since the sandy hook shooting. still no meaningful gun legislation. but still something is happening, the faces who will lead the fight for the remormon has begun to emerge as has the faces of those who will fight against them. some of these faces are new. some are expected, and all of them will play a role in what is going to become one of this country's most passionate and telling debates. >> jennifer: i'd like to start tonight by introducing you to christina taylor green she's an energic third grader with a passion for dancing and baseball. she's the only girl on her little league team, and girl after my own heart she has a

keen interest in politics, which is why two years ago today christina taylor green went to meet her congressional representative gabby giffords. on that day the same spray of gunfire that hit giffords killed christina green. the pain of losing a nine-year-old child is simply unimaginable. but her mother is turning her own heartbreak to a call to action in an new ad today. >> the sandy hook shooting. i know how much it hurts. my daughter was killed in a shooting. i have one question, when will you have the courage to stand up to the gun lobby? whose child will have to die next? >> jennifer: the sign some leaders have the courage to stand up. some leaders do have that

courage. three of them is gabby giffords herself. she and her husband announced an initiative to launch a national dialogue and raise funds to count the influence of the gun lobby. the second leader willing to stand up to the gun lobby is new york mayor michael bloomberg. his gun control group produced that ad that you just saw with christina's mother. he confirmed yes, that he's advising vice president joe biden that joe biden's task force will present to the president. it will likely include universal background checks, national database for gun sales mental health checks hasher penalties for guns near schools. all of these are steps in the right direction but today "new york times" columnist called on mayor bloomberg to do more than just advise on policy.

he called on him to put his money where his mouth is. and this is what he wrote quote, millions of americans indeed, a majority of them agree with you. they are looking for somebody to lead the charge against the nra. it is an effort worthy of your talents and your money. of course, mayor bloomberg does have the funds for it. in fact, while the nra spent $17 million on the 2012 election mayor bloomberg has a net worth of $22 billion. if money can, in fact, shape public opinion mayor bloomberg could bury the nra. today the mayor was evasive whether he would put his money towards the cause, but he did point to another leader who bloomberg is saying could do even more than mayor bloomberg himself can. >> well, i've got 350--

>> what are you going to do with your money? >> well, let's say it's going to be all given way. stanley mcchrystal has more credibility than i ever will have in terms of guns and the damage guns could do. >> jennifer: that's right the third leader to head the gun control general mcchrystal in afghanistan. today general mcchrystal called for much stricter gun laws. >> i spent a career carrying m-16s and it fires a 223 caliber round at 3,000 feet per second. when it hits a human body the affects are devastating. it is designed to do that. that's what our soldiers out to carry. i personally do not think that there any need for that kind of

weaponry on the streets. >> jennifer: well, even these three very powerful leaders mcchrystal bloomberg giffords, they could have a difficult time getting legislation passed because the gun lobby is mobilizing, the first ever gun appreciation day just two days before the presidential inauguration. the group is calling on supporters to turn out en masse at gun stores, ranges, and shows from coast to coast with their constitution american flags and hands off my guns signs to protest president obama's quote, post sandy hook assault on gun rights. some state legislatures are carrying out that agenda, including two states where mass shootings have already occurred. for example virginia, the site of the virginia tech shootings

and texas home to fort hood, they are both considering guess what loosening restrictions. but still there is room for hope. because in arizona the home of gabby if i giffords and christina taylor green in that state governor jan brewer today said she might be open to gun control measures. jan brewer, she told the arizona republic, i think gun control has been an issue that's been on the top of a lot of people's minds. it will be something that i'm sure will be addressed in the legislature, a and my ears are all open. jan brewer open to gun control. now i've heard everything. maybe, maybe something can happen maybe courageous leaders like bloomberg giffords, mcchrystal maybe they can

change the world. with me is john rosenthal from massachusetts. welcome. >> thank you. >> jennifer: house leader nancy pelosi said that congress must act on guns if she and gabby giffords and mayor bloomberg could we actually see a shift? >> maybe. if enough people pick up the phone and call their members of congress, it's possible. but virginia tech where 52 people were shot, kid were shot and 32 killed, congress' response was to game absolute immunity to lawsuit against the gun industry. we've seen over 600 americans buried from gun violence, a classroom every three days.

and we're hearing from michigan mcconnell, no, guns are off the table until the fiscal cliff and the debt ceiling. what could be more important than 87 dead americans every single day including kids. historically the republican party has been owned by the nra and the democrats have been literally sort of kowtowed into submission. there is a debate finally going on and it's outrageous that the gun guys are saying--and i'm a gun owner--but it's crazy. they're saying arm teachers, armed guards at school. now in the face of 20 dead babies they're going to parade around their guns and say our president, who is absolutely a second amendment supporter. he has done nothing on guns in his four years is now saying let's have a background check and a ban on assault weapons.

these are reasonable initiatives. >> jennifer: most of us watching this, and i know you are probably at the he head of this parade has seen this happen time and time again. there is always the focus and then it dies down. do you think that because of bloomberg's focus and financing that there could be a counter balance that might actually be effective as a way to battle the gun lobby in congress? >> i do think it's possible. and now is our moment. bloomberg has billions of dollars, and i was really heartened to see mark kelly and gabby giffords announce a super pac to support the good guys and oppose the nra candidates. if something doesn't happen, we have an opportunity for the president to use his executive orders. the republican house isn't going to let anything meaningful pass, but then i think the republicans and the democrats that don't

support reasonable gun violence legislation are going to be at risk in two years. that might be what it takes. but if we wait two years, that is 60,000 more dead americans from gun violence. >> jennifer: well, all right, we do know that the president is prepared to lead on this. as i mentioned, the washington post listed things that biden is likely to call for universal background checks, national database for weapons sales strengthen mental health check. they have to be considering an assault weapons ban. do you think this will go far enough? >> if there is a meaningful assault weapon ban i do think that will be helpful. but if we don't do a minimum simple background check for all gun sales then we're wasting our time. i mean, think about this, jennifer. i'm a gun owner. i go to the gun store. the federally licensed gun

sellers in america are the only one who have to do a background check. it's perfectly fine for private gun dealers, timothy mcveigh was a gun dealer at gun shows to sale sell guns without a background check. that's what is allowed. the common denominator in all the mass shootings has been the semi autosemiautomatic rifles. if they saw the pictures of the babies killed with a bush master designed for maximum soft tissue damage, it's a military weapon. it has no purpose whatsoever other than to kill a lot of people brutally and quickly. if people saw those pictures maybe congress would find their backbone. but if the public does not call their members of congress and insist we have the same consumer

protection standards that they have for toy guns but they exempt the regulation of real guns and if they do not require a background and ban on assault weapons. >> jennifer: you're speaking to people who are watching as a call to action that we hire these people, we can fire them. we have to give them instruction on how we want them to vote, and you've got to call your member of congress. that is what is so critical. let me quickly shift. the white house announced that vice president biden is going to be meeting with the nra and video game makers. is there any significance of that other than to bring them in the tent. how much influence will the nra have on the decisions of the task force? >> i hope not a lot. i do think that the nra will just try to idea block and get in the way. it's outrageous that they say that we should arm police and

teachers. i mean, there were two armed guards at columbine high school that were outgunned by the teenagers who had assault rifles and guns that they got at gun shows. that's not a solution. and it's not a solution to parade gun owners around. there are 70 million gun owners in this country and only 3 million members of the nra. the nra is an extreme outlier and it's gun owners like me and those watching the show to step up and create a new national organization of reasonable moderate gun owners and mark kelly and gabby giffords has started that today. if we build on that, the nra it's going to be neutralized. we're going to provide cover for reasonable moderate congress people to create gun laws like we created laws for automobiles and any other inherently dangerous product. we will reduce the 87 gun deaths

hovey got a lot of backlash about her remarks. she wrote back. my comments were meant to be protective of the privacy of family and our community as we work to move on and they were in no way intended as an insult to congresswoman giffords personally. too little, too plate. let's bring charlie pierce into the conversation. contributor editor of esquire and writes the political blog. he comes to us from west newton, massachusetts. welcome inside "the war room"." >> happy new year, governor. >> jennifer: happy new year. i know you wrote about this woman. i was curious with your take on it. if you had a chance to talk with debralee hovey what would you say to her. >> i would say stay off--limit measure facebook postings to pictures of her dog and what happens in the town hall council meetings, this is indicative of

her. if going forward gabby giffords and mark kelly follow through to push back against the nra, the slime machine will come after them. what happened to her will not make her immune. sarah braidly got slimed. jim brady got slimed. it's going to happen. i certainly don't have any reason to think they're not but i hope they're ready for it. debralee hovey is just the beginning of itism. >> jennifer: i totally agree with you. gabby giffords took a bullet. i guess she can take the slings and arrows for a good cause. do you think she would be the face of the cause like brady in the 80s, do you think she could be the rallying person? >> one thing that she has going for her that jim brady didn't have going for him. she is a natural politician, she

has worked in the milieu before. i think you'll see a couple of organizations pop up. i think you'll see a couple of organizations and i wouldn't be at all surprised if you saw an organization of gun owners pop up. i keep hearing about these millions of responsible gun owners who are does gusted with the nra doing. then a let them take over the nra, or let them start their own organization. i wouldn't be at all surprised if another organization all of america's gun owners was formed to say the nra is nothing more than a lobby for the gun manufacturers. it is in no way interested in its rank and file membership. we are. that would be one of the more interesting developments. if there were on the gun--i don't want to say the pro-gun side but on-- >> jennifer: responsible gun own percent coalition of responsible

gun owners. perhaps that's something that bloomberg's money could help finance, to help gather people who are rational gun owners, and this is not about taking away people's hunting weapons. this is not taking away our culture, which in many parts of the country has really grown up on hunting. it's just so ridiculous. >> no, they could have their first convention in the upper peninsula. >> jennifer: exactly, and you would go. >> i would be all about it absolutely. >> jennifer: in other news, you have been prolific this year. commentators said if chuck hagel is confirmed as defense secretary it will be the final nail in the coffin of the bush foreign policy era. do you agree with that? >> yeah, i do. i think it's a good assessment of where he's going to go. i will wait and see. i am a fan of chuck hagel as a

human being. politically we couldn't be more different than on two or three issues. as a human being i'm a big fan of him when he first went off off the reservation on the iraq war. obviously his biggest opposition will be the bureaucratic inertia in the pentagon. it's an enormous place. it's fueled by the defense industries more than the actual military themselves. and that revolving door between the upper levels of the military and defense contractors. one thing you will get from chuck hagel, you will get a concern for the men and women on the ground. that will be the most important part of having chuck hagel as a secretary of defense. he's the first infantry grunt to hold that job and i remembers what it's like. if there are think-tank cowboys who think they're going to go to

the president and try to sell him on a war they'll have someone pushing back really hard and they'll have to kick down the doors. >> jennifer: i love that about him. it's the most salient quality about someone who is going to lead the decisions whether or not our men and women are going into battle. he is a courageous guy. a lot of backbone. standing up against the bureaucracy, that is a huge deal. you have another interesting take this morning. you wrote about president obama's choice about myrile everies-williams to deliver the benedict. tell our audience who she is and why you think she's such a good pick. >> she was formerly the wife of the slain civil rights leader

medger everies in jackson mississippi, in front of his wife and children, by a back-shooting coward by the name of byron beckwith. she pursued the case for 30 years and got a brave attorney to take her case. it was made into movie called " "ghosts of mississippi." she has been a stalwart, stubborn, wonderful lady who dedicated herself to getting justice for her husband and finally got it. and remarkably this is the first time a non-clergymen or non-clergy person has been allowed to give the invocation at a presidential inaugural. i think it's terrific. i think it to put her in the spotlight is a great thing. >> jennifer: well, i think it is

@ñ@ñ [ ♪ theme music ♪ ] >> jennifer: we have good news and bad news tonight on the cost of healthcare in america. first, the good news. according to the obama administration the rate of increase in healthcare spending went up 3.9% in 2011. a mall amount. it's the same increase that we saw in 2009 and 2010. for the record those are the lowest up ticks in more than half a century. pretty good. now for the bad news. anthem blue cross wants to hike their premiums by 26%. insurers in florida and ohio have already increased patients' rates by 20%.

how is this happening and what can be done to stop it? we're going to put those questions to dave jones, who is leading the charge against the wild rate hikes that the insurance companies are planning. he's coming to us from sacramento. dave welcome inside "the war room." >> a pleasure to be with you jennifer. >> jennifer: tell us for people who have not been following this, why are these rate hikes happening in some states and not in others? >> the problem in california and other states is that there is nothing in the affordable care act or in state law that gives the insurance regulator the authority to reject excessive health insurance or hmo rate hikes. that's a glaring loophole in the affordable care act. the affordable care act has a lot of good things in "n" it. it will cover more americans and stop from insuring those with pre-existing conditions. now 37 states have adopted laws

on their state laws to do exactly that. california is not one of those. and so today our conclusion we found unreasonable anthem blue cross rate increase, this particular one was 10.6% for 12-month period on average on small businesses affecting about quarter of a million california residents. they're not alone. we've seen rate increases 10, 20, 40 times sometimes as high as 60%. and they have the legal authority to do it and i don't have the authority to stop it. >> jennifer: what good is it to have an insurance commissioner and why they not have given you the power. >> what is ironic, i have that power for car insurance and homeowners' insurance and property insurance since 1988, insurance commissioners have had

the authority to stop excessive rate hikes. but in california, that authority discuss does not extend to hmo products. for seven years i fought to pass the bill, but they have blocked that legislation. on the 2014 ballot we'll give a fighting chance to give the commissioner the authority. >> jennifer: when this doubt go to the people. the insurance company is on their side. they'll claim they have to raise the rates because their policy holders are older sicker and require more care. is that a legitimate argument? >> no, what you pointed to in the open something that the average medical cost inplace rate in the united states is about 3% to 4% on average. but health insurance and hmo are going up 10, 40, sometimes as

high as 50%. between those two cost trends lies the enormous profits that the companies are making. in california, they're going to make 21% return inequity inin 2012. that's on the backs of small businesses and families. families in california have to choose between paying for rent, buying food versus rising costs of health insurance. they can't afford it so they go without. >> jennifer: in states like california that has not given the insurance commissioner the teeth that is necessary to prevent these kinds of rate increases, people need to get state legislation. should it be done at the federal level? should that loophole be closed as an amendment to obama-care, or will that risk opening up the whole thing? >> that would be wonderful but i think it's very unlikely give the republicans control of the house that that would core.

senator dianne feinstein tried to do exactly that in 2010. she fought very hard to include language allowing for the rejection of excess excessive rates but the hmos and insurances were successful in keeping that out of the bill. the best to approach this is to enact state legislation. states who have done this and use this authority are showing much lower rate increase than states in california where we don't have this authority. >> jennifer: more of a call to action. you leave the insurance companies on their own they'll jack up those rates. dave jones we hope you get the power to block it. we're grateful to you for coming inside "the war room." >> thank you. >> jennifer: never let it be said that congress let the december trust of the american people stand in their way. the latest on their efforts to double down on their record-breaking unpopularity next in "the war room."

and it's amazing. they have earned it. >> they didn't work for it. they sure haven't been doing much in the last couple of years, they certainly did earn it. they have gotten completely out of touch with the american people. both parties to some degree. >> jennifer: but the republicans have taken it on the chin significantly. there was a survey from the pew research center that 48% approve of the way the president handled the fiscal cliff but 19% approve of the way the republicans handleed the fiscal cliff. >> not even republicans like the way republicans handled the fiscal cliff. >> jennifer: what will it take to get congress to behave in a way that is responsive to what the people want? >> out 435 districts only 10% faced the voters and had to make the case for their re-election. for the most part they're protected by jerrymandering,

redrawing of district lines to keep those guys this office. >> jennifer: the experiment that california has waged about the two top vote getters regardless of party, do you think that's a good thing that other states should model? >> we're going to find out if this top two primary works or not, like in california and a few others states, like louisiana. >> jennifer: you have a better answer? >> to let the non-party commission draw district lines. iowa has been doing it for decades. and five out of six or four out of five districts are competitive every year. there are districts drop by drawn by p by

bipartisan commissioners. >> he will understands this. we don't know him outside of washington, d.c. but he is he is respected and smart. >> jennifer: one of the other nominees which is john brennan, which seemed like he was going to be fine in getting through but lindsey graham from south carolina is call forgive a delay for john brennan. >> he served under george bush jr. >> jennifer: he's saying that we want to learn more about bengahzi. lendcy graham has raised his head to object to any and all these cabinets. >> they would call john mccain maverick because he would do whatever he thought. lindsey graham is trying to be maverick jr. >> jennifer: he has good ratings

in south carolina. >> he has good ratings right now, but we don't know which tea party candidate is going to run against him. jim dement from south carolina who just left, he was a true tea party right wing nut. a lot of south carolinaens especially republicans, don't think lindsey graham is a right wing nut too. >> jennifer: he has been prior to these past couple of years he has been a voice a reasonable, rational voice. >> sometimes he has sometimes he hasn't. >> jennifer: when he looks at climate change. >> yes. >> jennifer: he seemed to be reasonable. but all of a sudden he has taken this far tact to the right. >> he has a primary in a year and a half. >> jennifer: his numbers are pretty good. >> richard lugar's numbers were pretty good. >> jennifer: quickly your take on the virginia governor race poll out. former dnc terry mcauliffe is

think, cenk, you, that we can actually stoke congress to do something? do you have confidence that we might be able to shame them? >> cenk: you know, it's really interesting. we talked to congressman yarmouth on the show, and he thinks we can get it done. but congressman cohen is more skeptical. every day that goes by we get further away from bogey able to do it. i have to give the obama administration credit, they're considering really strong proposals. i'm hopeful. >> jennifer: cheng uygur hopeful on gun safety measures, i'm feeling good about it. that's all i can say. we'll be watching your show. >> cenk: thank you. >> jennifer: it's a new year with a knew a new congress, and that means plenty of ideas on how to tackle the country's problems. not all of them are good ones and some come straight out of crazy town. the first really bad idea is the

definition of hypocrisy, which is aig. the large insurer/reckless investor that nearly sunk our financial system. aig does not like their multi billion taxpayer bailout. they don't like the fact that it was, get this, too harsh. yes. you heard me. the money you and i gave them to save them from their own stupidity wasn't nice enough. aig is actually considering a lawsuit, a lawsuit against the u.s. government. against you because the terms of this bailout meant less profit for their shareholders. even though that's profit their shareholders wouldn't have had without the bailout in the first place. newly elected massachusetts senator elizabeth warren responded with a statement saying in part, aig should thank american tax payers for their

help, not bite the hand that fed them for helping them out in a crisis. we all should be very grateful that senator warren is serving on the banking committee. we also want to talk about this trillion dollar coin. for those who missed it, some including paul krugman some suggested that president obama can get around the debt ceiling by minting a trillion dollar coin and depositing it into the treasury. it does seem wacky by many people, but some are taking it seriously, including republicans who have introduced legislation to prevent this from happening. but i would like to bring perspective to the 1 trillion-dollar debate. there was a similar idea tried a few years ago on the simpsons. it didn't go well. take a look. >> the one-time printing of the
